"www.gatewayhr.in, commonly referred to as the Gateway HR platform (Job portal), is a website and web application provided by Gateway HR Consultants Pvt. Ltd (GHR) directly or through its affiliates, including Gateway HR Consultants Pvt. Ltd (GHR). Users with verified accounts can access the Gateway HR Platform to view and apply for jobs. Please note that jobs are posted by independent third parties unrelated to or affiliated with Gateway HR Consultants Pvt. Ltd.

 

When a user accesses the Gateway HR Platform, they are required to adhere to the Terms of Service and any other rules, regulations, or terms of use specified by GHR for the services offered through the platform. GHR reserves the right to modify these terms and conditions at any time, with updates posted on the platform. By using the Gateway HR Platform and GHR Services, users accept the modified terms and conditions.

 

GHR may also notify users of changes via email or other communication methods, and users have the option to indicate non-acceptance of the modifications within a specified time frame. Failure to exercise this option will be considered as the user's acceptance of the modified terms and conditions.

 

Some GHR Services may have additional rules and regulations, which take precedence if they conflict with these Terms of Service.

 

GHR retains the discretion to:

 

Restrict, suspend, or terminate a user's access to the Gateway HR Platform or GHR Services.

Modify or discontinue any part of the Gateway HR Platform or GHR Services.

Reject or remove user-submitted materials.

Deactivate or delete user accounts and associated information.

Set general practices and limits for platform use.

Transfer its rights and liabilities for all user accounts to another entity, with notification to users.

If a user breaches these Terms of Service or is believed to have misused the Gateway HR Platform or GHR Services, GHR can restrict, suspend, or terminate their access, delete user content, and take necessary technical and legal actions.

 

GHR will refund any platform fee if a user's account or GHR Services are suspended or removed due to GHR's negligence or deficiency, except in cases of user breach or circumstances beyond GHR's control.

 

By accepting these Terms of Service, users consent to receiving communications, including announcements, administrative messages, and advertisements from GHR or its partners, licensors, or associates.

 

Participation

Users can view and apply for jobs posted by potential employers for their organizations through the Gateway HR Platform and GHR Services. To apply for a job, users must provide accurate information about their education, qualifications, experience, and skills. While GHR does not support gender discrimination, some jobs may be gender-specific, which is determined by the job poster and not mandated by GHR.

By agreeing to these Terms of Service and applying for a job through the GHR Platform, users commit to providing accurate and non-misleading information. GHR has the right to suspend a user's account if inaccurate or misleading information is detected.

 

Job applications on the Gateway HR Platform remain active for 60 days from the application date, after which they are archived. Potential employers lose access to these Archived Job Applications. Users can reapply to the same job post (if still active) after 60 days.

 

Users are expected to adhere to the Code of Conduct while using the Gateway HR Platform and GHR Services."

 

 

"Intellectual Property Rights:

 

All software that underlies the Gateway HR Platform and the GHR Services, as well as the materials published on the GHR Platform (including but not limited to software, advertisements, written, audio and visual content, photographs, graphics, images, illustrations, graphs, charts, marks, logos, audio or video clips, animations, and more) are the property of GHR, its affiliates, partners, licensors, and associates. Users are prohibited from modifying, publishing, transmitting, participating in the sale or transfer, reproducing, creating derivative works, distributing, publicly performing, publicly displaying, or in any way exploiting any of the materials or content on GHR, whether in whole or in part, without obtaining explicit written permission from GHR.

 

User Content Responsibility:

 

Users are solely responsible for any materials they upload, post, email, transmit, or otherwise make available through the Gateway HR Platform, referred to as 'User's Content.' Users must confirm that they own all Intellectual Property Rights related to their User's Content and that it does not infringe on any third-party rights. Users also commit not to display or use any names, logos, marks, labels, trademarks, copyrights, or intellectual and proprietary rights of any third party on the GHR Platform without written authorization from the respective third party. Users agree to indemnify and protect GHR, its directors, employees, affiliates, and assigns against all costs, damages, losses, and claims, including litigation costs and counsel fees, that may arise from any third-party claims related to Intellectual Property Rights infringements due to the display or use of names, logos, marks, labels, trademarks, copyrights, or intellectual and proprietary rights on the GHR Platform by the User or due to the User's actions or omissions.

 

License to User Content:

 

Users hereby grant GHR, its affiliates, partners, licensors, and associates a worldwide, irrevocable, royalty-free, non-exclusive, sublicensable license to use, reproduce, create derivative works of, distribute, publicly perform, publicly display, transfer, transmit, and/or publish User's Content for purposes such as displaying User's Content on GHR, distributing it to potential candidates, and storing it in a remote database accessible by end users, for a charge. This license covers any form, medium, or technology used for distributing and storing User's Content.

 

Third-Party Sites and Services:

 

The GHR Platform may include links to third-party websites and mobile applications. Users are bound by the terms and conditions set by these third-party sites when using them. GHR has no control over the content of these third-party sites and cannot be held responsible for their content. In addition, GHR's inclusion of third-party content or links does not constitute an endorsement of these third-party websites or mobile applications.

 

Privacy Policy:

 

GHR collects information from Users, including registration details and payment information, which is subject to GHR's Privacy Policy. The information is not shared with other companies or entities without the user's permission. Users agree not to disclose or transfer personal information shared by GHR to sub-processors without ensuring appropriate safeguards. Users commit to using shared information exclusively for availing the services, not for personal or other business purposes. Misuse of this information may result in account deletion and future access restrictions to the Gateway HR Platform.

 

User Conduct:

 

Users must comply with the Terms of Service and other rules, regulations, and terms of use related to the Gateway HR Platform and GHR Services. Failure to comply may lead to remedial actions taken by GHR, including restricting, suspending, or terminating access, deactivating or deleting accounts, and transferring unused amounts to the user's bank account. Users agree to provide accurate and up-to-date information, not register or operate more than one account, and ensure they can receive communication from GHR.

 

Users must not use cheats, automation, unauthorized software, or engage in any disruptive or unauthorized activity related to the GHR Services. Unauthorized access, impersonation, and false information are also prohibited. Users must not engage in illegal activities or actions that threaten the unity, integrity, defense, security, or sovereignty of India.

 

Unauthorized access to the Gateway HR Platform is prohibited, and users must use the interface provided by GHR for access. Users must not use automated means to access, monitor, or copy content on the GHR Platform without prior written approval from GHR.

 

Eligibility:

 

The Gateway HR Platform is open to individuals aged 18 and above who reside in India. Users must have a valid email address and/or mobile phone number. GHR may bar individuals from accessing their account for violations of these terms.

 

 

 Release and Limitations of Liability

Users are to access the GHR Services provided via the Gateway HR Platform at their own discretion and risk. Under no circumstances shall GHR be held accountable or liable for any loss or damage experienced by Users or any other individuals or entities during their use of the GHR Platform.

 

By accessing the Gateway HR Platform and the GHR Services within, Users hereby release and agree to indemnify GHR, along with its directors, employees, partners, associates, and licensors, from any liability, cost, loss, or expense arising from their use of the Gateway HR Platform and GHR Services. This includes but is not limited to personal injury and property damage, whether the liability is direct, indirect, consequential, foreseeable, due to negligence, or otherwise.

 

GHR accepts no responsibility, whether jointly or severally, for any errors or omissions, whether on its own behalf or that of third parties, regarding the data or information compiled and published on the GHR Platform.

 

Users will be solely responsible for any consequences resulting from their access to GHR Services through illegal acts or non-compliance with these Terms of Service and other regulations related to GHR Services, including the provision of inaccurate personal information. Users also commit to indemnify GHR and its respective officers, directors, employees, and agents in the event of such occurrences, including but not limited to attorney fees and legal charges, on a full indemnity basis for any loss or damage suffered by GHR due to the User's actions.

 

Users shall indemnify, defend, and hold GHR harmless from any claims made by third parties or organizations arising from or related to the User's interaction with the GHR Platform. In no circumstance shall GHR be held liable to any User for acts or omissions connected to the User's engagement with the GHR Platform.

 

In consideration of GHR granting Users access to the GHR Platform, to the fullest extent allowed by law, Users waive and release any and all rights or claims, including present or future actions and causes of action, against GHR, its agents, directors, officers, business associates, group companies, sponsors, employees, or representatives for any injuries, accidents, or mishaps, whether known or unknown, anticipated or unanticipated, resulting from the provision of GHR Services.

 

Disclaimers

To the extent permitted by law, neither GHR nor its parent or holding company, subsidiaries, affiliates, directors, officers, professional advisors, or employees shall be held responsible for the deletion, failure to store, mis-delivery, or untimely delivery of any information or material.

To the extent permitted by law, GHR shall not be liable for any harm arising from downloading or accessing information or material, the quality of servers, products, GHR Services, or sites.

 

Any material accessed, downloaded, or otherwise obtained through the Gateway HR Platform is at the User's discretion, competence, acceptance, and risk, and the User will be solely responsible for any potential damage to their computer system or loss of data resulting from such actions.

 

GHR will make its best efforts to ensure that the GHR(s) is error-free and secure. However, neither GHR nor any of its partners, licensors, or associates makes any warranty that:

 

The Gateway HR Platform will meet Users' requirements.

Gateway HR Platform will be uninterrupted, timely, secure, or error-free.

The results from the use of Gateway HR Platform will be accurate or reliable.

The quality of any products, GHR Services, information, or other material obtained through the Gateway HR Platform will meet Users' expectations.

In case GHR discovers an error, it reserves the right, at its discretion, to rectify the error in a manner it deems appropriate, including setting off erroneous payments from amounts due to the User or deducting the erroneous payment amount from the User's account. If such remedies are exercised, GHR agrees to notify the User of the error and the actions taken to rectify it.

 

To the extent permitted by law, neither GHR nor its partners, licensors, or associates shall be liable for any direct, indirect, incidental, special, or consequential damages arising from the use of our sites, even if GHR has been informed of the possibility of such damages.

 

Any GHR Services hosted or provided, or intended to be hosted on the Gateway HR Platform and requiring specific permission or authority from any statutory authority, state or central government, or board of directors, shall be considered canceled or terminated if such permission or authority is not obtained or is denied either before or after the availability of the relevant GHR Services.

 

To the extent permitted by law, in the event of suspension or closure of any GHR Services, Users shall not be entitled to make any demands or claims of any nature.

 

Grievance Redressal Mechanism

If a User has any complaints or grievances related to:

(i) Content believed to violate these Terms (other than Intellectual Property Rights infringement),

(ii) Users' access to the Gateway HR Platform, or

(iii) Content believed to be obscene, defamatory, or related to impersonation in an electronic form,

the User can report such issues to us by writing to: diwakar@gatewayhr.in.

The complaint or grievance should include the following information:

 

Name and contact details, including name, address, contact number, and email address.

Relationship to the subject matter of the complaint.

Name and age of the person aggrieved or affected.

Clear identification of the content in question.

A statement of good faith belief that the content violates these Terms and Conditions.

Confirmation of the accuracy of the information provided.

GHR respects Intellectual Property Rights and requests Users to report any infringements. Users should provide the following information in a notice of infringement:

 

Identification of the copyrighted work allegedly infringed.

Identification of the allegedly infringing material on the GHR Platform.

Contact details, including name, address, email address, and phone number.

A statement of good faith belief that the use of the copyrighted material is unauthorized.

Confirmation of the accuracy of the information and the signer's authority.

Upon receiving a complaint, grievance, or notice, GHR reserves the right to investigate and take appropriate action. GHR may reach out to the User for further clarification or assistance with the investigation.
